Terms of Service

These Terms of Service ("Terms") govern your use of Imogen ("Imogen", "we", "us"). By creating an account or otherwise using Imogen, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

1. Who can use Imogen

You must be at least 13 years old to use Imogen, and old enough to enter into a binding agreement in your country. If you're under 18, you confirm a parent or guardian is okay with you using the Service.

2. Your account

You sign in to Imogen with Google, via Supabase Auth. You're responsible for keeping your account secure and for activity that happens under it.

3. What Imogen does

Imogen turns a written brief into an editable design, rendered live on a canvas, that adapts to a taste profile ("SOUL") that learns from the designs you keep. Designs are composed from vector and CSS primitives — Imogen does not generate photographic or AI-painted raster imagery. Generation is powered by third-party AI models (see §6 and §8).

4. Your content and your designs

Content you submit — briefs, uploaded reference images — and the designs Imogen generates for you ("Your Designs") belong to you. We don't claim ownership over Your Designs. You grant us a limited license to store, process, and display Your Designs back to you, and to send them to the third-party AI providers we use, solely to operate the Service.

Because designs are AI-generated, we can't guarantee exclusivity — a similar prompt from another user could produce a similar result. You're responsible for confirming a design doesn't infringe someone else's rights before using it commercially.

5. Acceptable use

You agree not to use Imogen to:

• Generate or request content that is illegal, hateful, or infringes someone else's rights.
• Abuse, reverse-engineer, or attempt to overload the Service.
• Scrape outputs at scale to build a competing product.

6. AI-generated content — please read

Imogen uses third-party large language models (currently DeepSeek) to turn your brief into a design. AI can make mistakes: output may be inaccurate, generic, or not match what you actually asked for. We don't guarantee that designs are original, error-free, or fit for any particular purpose. Review anything Imogen generates before relying on it, especially for commercial or legal use.

7. Third-party services

Imogen is built on top of third-party providers: DeepSeek (AI model provider, processes prompts and attachments to generate designs), Supabase (authentication, database, file storage), and PostHog (product analytics). These providers process data on our behalf, under their own terms. See our Privacy Policy for what's shared and why.

8. Fees

Imogen may offer free and paid tiers. If we introduce paid features, pricing and billing terms will be shown to you before you're charged.

9. Termination

You can stop using Imogen and delete your account at any time from Settings. We may suspend or terminate access for violating these Terms or the law.

10. Disclaimers and limitation of liability

Imogen is provided "as is," without warranties of any kind. We don't guarantee the Service will be uninterrupted or error-free. To the maximum extent permitted by law, Imogen isn't liable for indirect, incidental, or consequential damages arising from your use of the Service.

11. Changes to these Terms

We may update these Terms from time to time. Continuing to use Imogen after a change means you accept the updated Terms — we'll update the date at the top of this page when that happens.
